Terms of Use

These Terms of Use (“Terms”) govern your access to and use of the apps, websites, and other services offered by Jaffaround (“Jaffaround”, “we”, “us”), including the JaffaPhoto iOS app (each, a “Service”). By installing or using any Service you agree to these Terms. If you do not agree, do not use the Service.

1. Eligibility

You must be at least 13 years old (or the minimum age required in your country) to use a Service. If you are between the minimum age and the age of majority where you live, your parent or guardian must agree to these Terms on your behalf.

2. Your account

Some Services let you sign in with Apple. You are responsible for keeping access to your Apple ID secure. If you suspect unauthorized access to your account, contact support@jaffaround.com.

3. Your content

Photos and other content you upload through a Service remain yours. You grant Jaffaround a limited, non-exclusive, royalty-free license to host, transmit, process, and restore that content for the sole purpose of operating the Service for you. We do not use your content to train machine-learning models, sell to third parties, or display publicly.

You are responsible for ensuring you have the right to upload the content you submit, and that doing so does not violate anyone else’s rights or the law.

4. In-app purchases & credits

JaffaPhoto includes a limited number of free uses of its Backup & Delete and Original-Retrieval workflows. Once your free uses are exhausted, additional runs are available as one-time, consumable in-app purchases through Apple. All purchases are subject to Apple’s billing terms and refund policy. Consumable purchases are not restored after deletion and re-install — once consumed, they are consumed.

Prices, free quotas, and purchasable quantities may change with notice in-app and in the App Store listing.

5. Acceptable use

You agree not to:

• Reverse engineer or otherwise attempt to extract source code of a Service, except where applicable law expressly permits;
• Use a Service to upload, store, or transmit content that is illegal, harassing, infringing, or that contains malicious code;
• Probe, scan, or test the vulnerability of any Jaffaround system without prior written permission;
• Resell, sublicense, or use a Service to provide a competing offering.

6. Termination

You may stop using a Service at any time and request account deletion as described in our Privacy Policy. We may suspend or terminate your access if you materially breach these Terms or if continued operation of an account presents a security or legal risk. We will give reasonable notice where the law and the circumstances permit.

7. Service changes & availability

We are continually improving the Services. Features may be added, changed, or removed. We do not guarantee uninterrupted availability; the Services may be unavailable from time to time for maintenance, upgrades, or reasons outside our control.

8. Warranty disclaimer

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE”, WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICES WILL BE ERROR-FREE OR THAT ANY DATA WILL BE PRESERVED INDEFINITELY. ALWAYS KEEP YOUR OWN BACKUPS OF IRREPLACEABLE CONTENT.

9. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, JAFFAROUND WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF DATA, PROFITS, OR REVENUE, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF A SERVICE. OUR TOTAL LIABILITY ARISING OUT OF OR RELATING TO THESE TERMS WILL NOT EXCEED THE GREATER OF (A) THE AMOUNTS YOU PAID TO US FOR THE SERVICE IN THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO THE LIABILITY OR (B) USD $20.

10. Indemnification

You agree to defend, indemnify, and hold harmless Jaffaround from any claims, damages, or expenses (including reasonable legal fees) arising out of your breach of these Terms or your misuse of a Service.

11. Governing law & disputes

These Terms are governed by the laws of [JURISDICTION], excluding its conflict-of-laws rules. Any dispute arising out of or relating to these Terms or a Service will be brought exclusively in the courts of [JURISDICTION], and you consent to the personal jurisdiction of those courts.

12. Apple App Store additional terms

If you obtained JaffaPhoto from the Apple App Store, you acknowledge that these Terms are between you and Jaffaround only, not with Apple. Apple is not responsible for the Service or its content. Apple has no obligation to provide support for the Service. In the event of any non-conformance with applicable warranties, you may notify Apple, which will refund the purchase price (if any). Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.

13. Changes to these Terms

We may update these Terms from time to time. If changes are material we will update the “Last updated” date above and, where appropriate, notify you in-app or by email. Continued use of a Service after changes take effect means you accept the updated Terms.
